Free Kathleen Folbigg

Dear Attorney General
 
I call on you to issue advice to the Governor to pardon Kathleen Folbigg and release her from prison immediately. The inquiry into her convictions has shown there is reasonable doubt about her guilt, but she is still in prison. 
 
This is a grave miscarriage of justice. Counsel Assisting the inquiry has made submissions that upon all of the evidence there is reasonable doubt as to Ms Folbigg’s guilt and that her children may have died from natural causes. The Director of Public Prosecutions has endorsed this submission. Legal experts agree that in light of new evidence it is untenable to continue to hold Ms Folbigg in prison for any longer. 
 
When new evidence was found in the case of Lindy Chamberlain she was pardoned within hours despite the inquiry into her convictions concluding two years later. Now, you face what could be the biggest issue of justice in your term as Attorney General. Doing the right thing in these circumstances requires legal expertise, a commitment to justice and upholding the rule of law. I am calling on you to do the right thing and release Ms Folbigg immediately. 
 
Kathleen has suffered enough. Ms Folbigg has always maintained her innocence. She has been assaulted and abused in prisons over two decades, she has been vilified in the media and now we know she was wrongly convicted. We can never give those years back to Kathleen but you can do the right thing and release her now. 
 
The decision to keep Kathleen in prison despite clear and compelling evidence that she was wrongly convicted is legally and politically untenable. Your power to issue advice to pardon her is not contingent on the report from the inquiry being handed down. You have the power to do it right now. 
 
I am calling on you to please issue advice to the Governor to release Kathleen Folbigg immediately. Your delay is your denial of justice for Ms Folbigg.

Kathleen Folbigg was convicted for the murder of three of her children and manslaughter of one in 2003 and has been in maximum security prison ever since. Kathleen has maintained her innocence. An inquiry has now found that there is reasonable doubt about her guilt, that on the basis of the large volume of medical and scientific evidence presented her children may have died of natural causes. But Kathleen is still in prison.

The NSW Attorney General has the legal power to release her - he has the power to request the Governor to pardon Kathleen and release her immediately. In light of the circumstances and all of the evidence every minute Kathleen remains in prison is compounding the gravest injustice.

Wrongful imprisonment is the gravest of injustice. We need to call on the Attorney General to take the steps to immediately release Kathleen.
